DARCY DAOUST (LL.B.) (B.A. Hon)

HR Consultant & CEO

Why choose me?  I am a seasoned professional with a passion for helping businesses thrive. My experience and strategic approach to Employer and Employee relations make me an asset to my clients.

Prior to founding D&DCPD, I was a litigation lawyer practicing in the areas of Labour and Employment Law. During this time I represented both Employers and Employees as well as Unions and their members. During my legal career I also spent many hours in court as a Civil Litigation lawyer.

Having seen the strain that the court process can have on both employers and employees, I understand the importance of helping small and medium businesses foster positive relationships with their Employees. I have also seen the adverse effects a toxic work environment can have on an Employee's productivity and mental health.

Whether through the mediation process or simply by working with other HR professionals to find progressive solutions, I always takes on issues from a collaborative model first and foremost. I am excited to bring my unique blend of legal knowledge and hands on experience to support business owners and employees in creating open, positive, inclusive workplaces that ensure employee retention and efficiency.

By focusing on collaboration, empathy, and effective communication, my aim is to cultivate environments where Employers and Employees feel valued and motivated to contribute their best.

Hello Employers and Employees.  Some of the fundamental issues I have seen that lead to workplace disputes and litigation include a lack of proper policy implementation and monitoring as well as ineffective or outdated employment contracts.

Workplace Policies:

Many small business owners are not aware that business, having at least one Employee requires the implementation of human rights anti-discrimination policies and workplace anti-harassment policies. These policies have to give clear direction about how an Employee can make a complaint and how the Employer must act when a complaint is made. These policies are vital not only for fostering a safe and inclusive work environment but also for ensuring legal compliance.

Failure to implement these policies can lead to severe consequences, including legal penalties and fines. Businesses can face substantial fines for not providing a clear recourse for Employees who suffer discrimination or harassment. Beyond financial repercussions, the absence of these policies can damage the company's reputation, erode employee trust, and lead to high turnover rates. By proactively establishing and enforcing these policies, businesses not only comply with legal requirements but also create a supportive, respectful, and productive work environment.

Employment Contracts:

Written employment contracts play a pivotal role in safeguarding both Employers and Employees. For Employers, a well-crafted contract serves as a vital protection tool, clearly outlining terms of employment, duties, and expectations. This not only minimizes potential disputes but also provides a legal framework for addressing issues such as termination, compensation, and workplace policies. By having everything documented, employers can ensure compliance with Ontario's employment laws and regulations, reducing the risk of costly legal battles.

For Employees, a written contract is equally important as it defines their roles and responsibilities from the outset. This clarity helps prevent misunderstandings and fosters a transparent, professional relationship between the Employer and Employee. Employees can refer to their contract to understand their rights, benefits, and obligations, empowering them to perform their duties with confidence and security. In essence, a written contract provides peace of mind for both parties, laying the foundation for a productive and harmonious working environment.

If you are an Ontario business owner or an Employee who has questions about your obligations about policies and contracts as well as any other question feel free to contact me to discuss.
