Understanding Your Rights as a Piece Work Employee

In Ontario, piece work employees are entitled to the same protections as hourly and salaried workers under the Employment Standards Act (ESA). Employers cannot deny you the basic rights that all employees enjoy. Here are the key protections you should be aware of:


1. Minimum Wage Guarantee

Even if you are paid per piece, your total earnings must equal or exceed the minimum wage based on your hours worked. For example:

  • If you work 25 hours and earn $350 from piece work, your hourly rate would be $14 per hour.

  • If the minimum wage is higher than this amount, your employer must compensate for the difference.


2. Hours of Work and Overtime Pay

Piece work employees are subject to the same rules regarding maximum work hours, rest periods, and overtime as other workers. If you work beyond the standard hours, you are entitled to overtime pay regardless of the piece-rate structure.


3. Public Holidays and Vacation Entitlements

You are entitled to the same vacation and public holiday rights as other employees, including:

  • Public Holiday Pay: You must be paid for statutory holidays, even if you are paid per piece.

  • Vacation Time & Pay: Your vacation pay is calculated as a percentage of your total earnings.


4. Termination and Severance Rights

If your employment is terminated, you may be entitled to:

  • Notice or pay in lieu of notice.

  • Severance pay (if you qualify based on your length of service and employer size).
